Terms of Sale
These terms apply when you buy a digital product from Designed Calm LLC (“we,” “us”), which does business as Go to Market Helper, through Gumroad. Gumroad is the merchant of record and processes your payment. We are the licensor, and we handle the content, refunds, and support. These terms are linked on the product page and at Gumroad checkout. By completing your purchase, you agree to them.
Seller: Designed Calm LLC, 2710 Alpine Blvd, Unit K #1298, Alpine, CA 91901. Our refund policy is in Section 3.
1. What you’re buying
You are buying a license to use digital files (books, field kits, workbooks, and templates), not ownership of the underlying content. We and our licensors keep all rights not expressly granted.
2. License
- Individual license: one named person (you or one person you name).
- Team license: up to 10 named people working for one legal entity.
- You may copy text from the templates into documents you send to manufacturers, advisers, and colleagues, and they may keep those documents.
- You may not resell, share, post, or distribute the books, blank templates, or workbook, or use them to create a competing product or a paid deliverable for clients. This does not stop you from using the templates in your own business, including for agreements your own company signs.
- If you break these license terms, your license ends and you must delete your copies.
3. Refunds
Full refund within 14 days of purchase, for any reason. Reply to your purchase receipt to request one. We process refunds through Gumroad. When Gumroad issues your refund, your license ends and you agree to delete your copies. This does not affect any rights you have under applicable law.
4. Educational content only
The products provide general educational information and planning tools. They are not legal, regulatory, tax, engineering, quality, safety, customs, or other professional advice, they are not tailored to your facts, and buying or using them does not create an attorney-client or other professional relationship. Laws vary by state and country, so check the rules where you do business. Templates and checklists are not contracts. Have qualified professionals review any agreement or consequential decision. Regulatory, duty, and cost information changes. Examples are fictional and illustrative.
5. No warranties
To the fullest extent permitted by law, the products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the products will meet your needs or produce any particular result.
6. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, or for losses relating to manufacturing, product quality, recalls, suppliers, customs, or regulatory matters, arising from your use of the products. Our total liability for any claim relating to a product is limited to the amount you paid for it. These limits do not apply to our fraud, willful injury, or violation of law, or to rights the law does not let you waive. If the law where you live does not allow a limit, that limit applies only as far as that law allows.
7. Updates
We may provide corrections and updates to the version you purchased at no charge. We are not obligated to provide future editions or new products.
8. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Before you file a claim, email us at designedcalm@gmail.com with a short description of the problem and give us 14 days to resolve it. If the problem is not resolved within that time, either of us may request non-binding mediation administered by the American Arbitration Association under its mediation procedures then in effect. Mediation will take place in San Diego County, California, or by video conference if you prefer. Nothing in these terms limits your right to use small claims court or any consumer right that the law does not allow you to waive.
9. Changes
We may update these terms for future purchases. The terms in effect when you bought apply to that purchase.
